PCS Engineering, Inc. Objet grants You permission to use the Site and the Content for Your personal information, including internal business use, and to download or print a copy of any portion of the Content to which you have properly gained access solely for such limited use and for no other purpose, provided that:  (i) except as expressly provided herein, You will not use, copy, modify, distribute, transmit, broadcast, display, sell, license, de-compile, or otherwise exploit for any other purposes any part of the Site or the Content without PCS Engineering, Inc.’s  prior written authorization; (ii) You acknowledge that any Content that may be available to download or access from the Site is the copyrighted work of PCS Engineering, Inc.  and You agree to retain and preserve all copyright or other proprietary notices intact and provide the following attribution: “Information identified here is the proprietary property of PCS Engineering, Inc. and was taken from www.objet.com”; (iii) You agree not to circumvent, disable or otherwise interfere with security-related features of the Site or features that prevent or restrict use or copying of any Content or enforce limitations on use of the Site; (iv) You comply with any applicable law and not use Content or submit information in a fraudulent way; and (v) You comply with these Terms.  Failure to abide by the Terms will be considered a breach and will result in automatic and immediate termination of Your grant to use the Site and Content, and may entitle PCS Engineering, Inc.  to commence legal proceedings against You.  PCS Engineering, Inc.  reserves the right to terminate Your access to the Site at any time, in its sole discretion, immediately and with or without cause.

The Site permits You to submit information for registration or information purposes.  You agree that any such information submitted by You shall be governed by and subject to these Terms as well as the Privacy Policy.

The Site may contain links to third party websites that are not owned or controlled by PCS Engineering, Inc..  Unless specifically otherwise indicated in writing within the Site, PCS Engineering, Inc.  is not affiliated with those websites, has no control over those websites, and assumes no responsibility for the content, privacy policies, or practices of any such websites.  By using the Site, You expressly release PCS Engineering, Inc. from any and all liability arising from Your use of any third-party website.  Accordingly, We encourage You to be aware when You have left the Site and to read the terms and conditions and privacy policy of each other website that You visit.

Content on the Site is provided to You “AS IS” for Your personal information, including internal business use, only.  PCS Engineering, Inc.  attempts to be as accurate as possible.  However, PCS Engineering, Inc.  cannot and does not warrant that the Content is accurate, complete, reliable, current, or error-free.  PCS Engineering, Inc.  may make improvements and/or changes in the products and/or the materials and/or the services described in the Site and Content at any time.  PCS Engineering, Inc.  reserves the right to make changes in or to the Content, or any part thereof, according to its sole judgment, without the requirement of giving any notice prior to or after making such changes. Your use of the Content, or any part thereof, is made solely at your own risk and responsibility.

You agree to defend, indemnify and hold harmless PCS Engineering, Inc.  and its respective officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs and expenses (including but not limited to attorney's fees) arising from: (i) Your use of the Site; (ii) Your violation of these Terms; or (iii) Your violation of any third party right, including without limitation any intellectual property or privacy right.

11. Assignment

These Terms, and any rights and licenses granted hereunder, may not be transferred or assigned by You, but may be assigned by PCS Engineering, Inc.  without restriction.

12. Survival

The provisions in the paragraphs above labeled INTELLECTUAL PROPERTY RIGHTS, DISCLOSURE, LIMITATION OF LIABILITY AND WARRANTY, INDEMNITY, and GENERAL will survive any termination or expiration of these Terms

13. Disclaimer

There are no warranties of any kind, express or implied, in connection with the documentation or other information on this website. This information is provided AS IS.  PCS Engineering, Inc.  shall not be liable for any damages for use of this information, including without limitation, consequential, punitive, indirect or direct damages.

Any reference on this website or in the information available from the website to third parties, third party materials, websites or trademarks is provided for convenience only and does not in any manner serve as an endorsement of that third party material.  PCS Engineering, Inc. has no liability for such third party materials.

All data provided herein, which is related to consumables, was collected from specific specimens and tests conditions and is provided for information only.  Characteristics may vary if different specimens and test conditions are applied. Unless expressly provided in writing, no warranties are made and warranties of merchantability or fitness for a particular purpose are expressly disclaimed.

PCS Engineering, Inc.  reserves the right, in its sole discretion, to discontinue or modify any aspect of the Site or the Content at any time.  These Terms and the relationship between You and PCS Engineering, Inc.  are governed by and construed in accordance with the laws of United States, without regard to its principles of conflict of laws.  You agree to submit to the personal and exclusive jurisdiction of the courts located in Towson MD, and waive any jurisdictional, venue, or inconvenient forum objections to such courts.  These Terms, together with the Privacy Policy and any other legal notices published by PCS Engineering, Inc. on the Site, shall constitute the entire agreement between You and PCS Engineering, Inc. concerning the Site.  If any provision of these Terms is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect.  Failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.  YOU AND PCS Engineering, Inc.  AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE SITE MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION BECOMES KNOWN.  OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.
